This Privacy Policy explains how Loanpro LLC ("Loanpro," "we," "us," or "our"), a licensed mortgage broker in California, Colorado, Tennessee, Florida, South Carolina, and Montana, collects, uses, shares, and protects your personal information when you use our digital application, borrower portal, or website (www.loanpro.com) (collectively, the "Service"). By using the Service, you consent to the practices described in this policy. Data Retention and Security

 

We retain your personal and sensitive information (e.g., Social Security numbers, loan applications) for up to 6 years, as required by GLBA, TILA, RESPA, IRS and State Licensing specific regulations for financial records, or longer if needed for legal or business purposes. We use industry-standard security measures, such as encryption, secure servers, and access controls, to protect your data, as required by GLBA. However, no online system is 100% secure, and we cannot guarantee absolute security.

Consent for Communications

 

By providing your phone number, you consent to receive automated calls, SMS, or pre-recorded messages for loan-related updates (e.g., application status, disclosures) or marketing, as permitted by the Telephone Consumer Protection Act (TCPA). These Terms of Use govern your access to and use of Loanpro’s digital application, borrower portal, and website (www.loanpro.com) (the “Service”). By using the Service, you agree to these terms. If you do not agree, please do not use the Service.

Eligibility

You must be at least 18 years old and be interested in information about or applying for financing in a state where Loanpro is licensed (California, Colorado, Tennessee, Florida, South Carolina, Montana) to use the Service. By using the Service, you represent that you meet these requirements.

Use of the Service

  • Permitted Use: You may use the Service to apply for mortgage loans, upload documents to our borrower portal, access account information, or communicate with Loanpro.
  • Prohibited Use: You may not use the Service for illegal purposes, to violate any laws (e.g., TILA, RESPA), or to interfere with the Service’s operation (e.g., hacking, introducing malware).
  • Accuracy of Information: You agree to provide accurate, complete, and current information, including sensitive information like Social Security numbers, bank statements, and tax returns. Inaccurate information may delay or prevent loan approval.
  • No Commitment to Lend: Submitting an application through the Service does not constitute a commitment to lend. All loan approvals are subject to credit approval, verification of information, and compliance with applicable laws (e.g., TILA, RESPA). Loanpro does not guarantee loan approval, specific loan terms, or interest rates.
  • Indemnification Clause: You agree to indemnify Loanpro from claims arising from your misuse of the Service or violation of these terms.
  • Severability: If any provision is invalid, the remaining terms remain in effect.
  • Force Majeure: Loanpro is not liable for delays due to events beyond our control (e.g., natural disasters).
  • Updates Notification: We may update these terms; continued use constitutes acceptance.

Intellectual Property

Dispute Resolution

You waive the right to participate in class actions. This clause does not limit your rights to pursue claims under federal or state law (e.g., TILA, RESPA).

Governing Law

These terms are governed by California law, without regard to conflict of law principles, except where preempted by federal law (e.g., E-SIGN).

Loanpro eConsent and eDisclosure Agreement

This eConsent and eDisclosure Agreement ("Agreement") outlines how Loanpro LLC ("Loanpro," "we," "us," or "our"), a licensed mortgage broker in California, Colorado, Tennessee, Florida, South Carolina, and Montana, uses electronic communications, disclosures, and signatures for our website (www.loanpro.com), digital application, borrower portal, or general inquiries (collectively, the "Service"). By agreeing to this Agreement, you consent to receive and sign documents electronically, as permitted by the Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Uniform Electronic Transactions Act (UETA), as adopted in our licensed states and any additional states where we may operate in the future.

This Agreement applies to all users, whether you are submitting a general inquiry (e.g., via a contact form or phone) or applying for a mortgage loan through our digital application. It covers all disclosures, notices, records, and documents ("Loan Documents") related to your inquiry or application, including but not limited to loan estimates, closing disclosures, good faith estimates, and other communications required by the Truth in Lending Act (TILA)Real Estate Settlement Procedures Act (RESPA), and state regulations.

Definitions:

  • "You" and "Your" refer to the individual(s) submitting an inquiry or application, including any co-borrowers.
  • "We," "Us," and "Our" include Loanpro LLC, our affiliates, third-party vendors, and lending partners involved in processing your inquiry or application.

Please read this Agreement carefully and affirm your consent to conduct business with us electronically before proceeding.

Scope of Consent

By agreeing to this Agreement, you consent to the following:

  • Electronic Delivery: Receive all Loan Documents and communications electronically via email, our online portal, SMS, or other electronic means. This includes, but is not limited to:
    • Loan-related disclosures (e.g., loan estimates, closing disclosures, good faith estimates).
    • Updates on your inquiry or application status (e.g., document requests, approval updates).
    • Marketing messages about our services (e.g., new loan products, promotions).
  • SMS/Text Communications: By providing your phone number, you expressly consent to receive automated calls, SMS/MMS messages, and pre-recorded messages from us or our affiliates for:
    • Loan Updates: Notifications about your inquiry or application (e.g., status updates, required documents).
    • Marketing Purposes: Promotional offers or information about our mortgage products. This consent applies even if your number is on a Do Not Call registry and is not a condition of inquiring about or applying for our services. Standard message and data rates may apply.   • Electronic Signatures: Use electronic signatures to execute Loan Documents, which are legally binding and equivalent to handwritten signatures in all states where Loanpro is licensed and any future states where we may operate.
  • Third-Party Involvement: Receive electronic communications from our affiliates, third-party vendors (e.g., credit vendors), or lending partners (e.g., wholesale lenders, escrow companies) as necessary to process your inquiry or application.
  • Compliance: This Agreement complies with federal laws (E-SIGN, UETA, TILA, RESPA, TCPA) and state regulations in California, Colorado, Tennessee, Florida, South Carolina, Montana, and any future licensed states.

How We Can Reach You

  • You must promptly notify Us if there is a change in Your email address or in other information needed to contact You electronically.
  • We will not assume liability for non-receipt of notification of the availability of eDisclosures in the event Your email address on file is invalid; Your email or Internet service provider filters the notification as "spam" or "junk mail"; there is a malfunction in Your computer, browser, Internet service and/or software; or for other reasons beyond Our control.

Withdrawing Consent

You may withdraw your consent to electronic communications and signatures at any time by contacting us at:

Withdrawal will not affect the validity of previously signed documents or received disclosures. However, it may delay or prevent the processing of your inquiry or application, as we may not be able to provide all services electronically. If you withdraw consent, we will provide paper copies of required Loan Documents (e.g., TILA/RESPA disclosures) where feasible, though additional fees or delivery delays may apply as permitted by law.

Hardware and Software Requirements

To access, view, and retain electronic Loan Documents, you need:

  • A device with internet access (e.g., computer, smartphone, tablet).
  • A compatible web browser (e.g., Chrome, Safari, Firefox) with current updates.
  • Software to view PDFs (e.g., Adobe Acrobat Reader).
  • A valid email address and/or mobile phone number for receiving communications.

If your hardware or software no longer meets these requirements, you must withdraw your consent and notify us immediately.

Requesting Paper Copies

You may request paper copies of any electronic Loan Documents at no additional cost, except where permitted by law (e.g., for duplicates or expedited delivery). To request copies, contact us at:

We will mail the copies to the address on file within a reasonable timeframe, typically within 7–10 business days.

Changes to This Agreement

We may update this Agreement to reflect changes in our practices or legal requirements. Your continued use of the Service after such changes constitutes acceptance of the updated Agreement.

Credit Authorization

By clicking the "I/We agree to give authorization to run a credit check on financial history" checkbox, I/we hereby grant permission for us to obtain all information deemed necessary to process your mortgage loan application. This information includes, but is not limited to, your past and present employment status, your deposit accounts, your past and present consumer credit record, your mortgage record, and/or your rental record. Loanpro LLC, at its discretion, will utilize soft credit inquiry reports whenever possible and for most home purchase pre-qualification requests.
